Agreement and eligibility
These Terms govern use of Arvin's website, dashboard, APIs, embedded assistant, and related services. By creating an account or using the service for a business, you agree to these Terms and represent that you have authority to bind that business. You must be at least 18 or the age of majority where you live. If you do not agree, do not use the service. Visitors who chat with an assistant on a customer's website are also subject to that customer's terms and privacy notice.
What Arvin provides
Arvin reads website pages and material a customer selects, uses AI to answer visitor questions, and can capture leads, take bookings, hand a chat to a team member, speak replies, and send configured notifications. Features depend on setup, plan, availability, and connected services. AI can misunderstand a question or give an inaccurate or incomplete answer, even when citing a source. You are responsible for checking your assistant's sources, settings and behavior before and after publishing it. Do not rely on Arvin as a substitute for professional, emergency, medical, legal or financial advice.
Your account and team
Keep account credentials secure, provide accurate information, and promptly tell us about unauthorized access. You are responsible for activity by your team and for assigning appropriate roles. You may only connect sites and services you own or are authorized to manage. A public widget token is meant to be embedded in an approved site; do not use it to bypass domain restrictions, quotas or other controls.
Your content and visitor data
You retain ownership of your site content, instructions, and visitor data. You grant Arvin and its service providers a limited right to host, process, index, transmit and display that material as needed to provide and secure the service. You confirm you have the rights and notices needed for that processing. You are responsible for your website's privacy notice, required cookie or chat disclosures, visitor consents, and how your team uses leads and bookings. Do not submit content that infringes rights, violates law, or contains information you are not authorized to share.
When Arvin acts on your behalf for visitor data, you control the purpose of that processing. Contact us if you need a separate data processing agreement or specific retention terms. Our Privacy Policy explains our practices and how visitors can make requests.
Acceptable use
Do not use Arvin to deceive people about whether they are speaking to AI, impersonate others, send unlawful or unsolicited messages, collect sensitive information without a lawful basis, target children under 13 without an appropriate arrangement, or make decisions that have legal or similarly significant effects on a person without required human review and safeguards. Do not probe, disrupt, scrape or reverse engineer the service, interfere with another account, or exceed published limits. We may suspend use that threatens the service, other users, or the public while we investigate.
Third-party services and integrations
Shopify, Wix, WordPress, Google Calendar, Stripe, OpenAI, ElevenLabs and other connected services have their own terms. You are responsible for permissions and settings in the services you connect. A webhook sends configured event details to the destination you choose; keep that destination and its signing secret secure. We are not responsible for third-party outages or changes beyond our control. If an integration is disconnected, affected features may stop working.
Plans, billing and cancellation
Current plan features, included conversations and prices are shown on the pricing page and at checkout. A paid subscription renews at the interval shown during checkout until canceled. Stripe processes payment and provides the billing portal for payment methods, invoices and cancellation. A cancellation takes effect as shown in that portal; access to paid features may continue through the paid period. Additional conversation packs, where offered, are one-time purchases. Taxes may apply. We will give notice of a price change as required by law. Except where law requires otherwise or we expressly state it at purchase, fees already paid are nonrefundable. Service changes and availability
We may update the service, models, integrations and limits to maintain security or improve operation. We may suspend or end access for a material breach, nonpayment, abuse, or legal necessity. We will give reasonable notice when practical. You may stop using the service and cancel a paid plan through the billing portal. Ending access does not erase payment obligations already incurred or provisions that by their nature should survive, including ownership, disclaimers and liability limits.
Intellectual property
Arvin and its licensors own the service, software, design, trademarks and documentation. We grant you a limited, nonexclusive right to use the service during your account term in accordance with these Terms. You may not resell the service as your own or remove ownership notices without our permission. Feedback you voluntarily provide may be used to improve Arvin without an obligation to you.
Disclaimers and liability
To the extent permitted by law, Arvin is provided “as is” and “as available” without warranties of uninterrupted service, error-free AI output, fitness for a particular purpose or noninfringement. Nothing in these Terms limits a right that cannot legally be waived. You remain responsible for decisions made using assistant output and for obligations to your visitors and customers.
To the extent permitted by law, Arvin is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability arising from the service will not exceed the amount you paid Arvin in the twelve months before the event giving rise to the claim, or US $100 if you paid nothing. This limit does not apply where prohibited by law.
Disputes, changes and contact
Contact us first at [email protected] so we can try to resolve a concern. Applicable law and the courts with jurisdiction will govern any dispute; these Terms do not require private arbitration or waive a right to bring a claim where law protects that right.
We may revise these Terms as the service or law changes. We will post the updated version and date here, and provide additional notice for material changes when required. Continuing to use Arvin after the new Terms take effect means you accept them.
